By accessing or using Prometheus, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service, including any future modifications. If you do not agree to these terms, you must immediately stop using our services. These terms form a legally binding agreement between you and our company. We reserve the right to change or modify any of the terms and conditions contained in this agreement at any time. Such changes or modifications will be effective immediately upon posting on our website. Your continued use of the service constitutes your acceptance of any changes to the terms.
It is your responsibility to review these terms periodically for changes. You should ensure that you remain compliant with these terms as they govern your access and use of Prometheus. If any modification to the terms is unacceptable to you, you must stop using the service. By continuing to use Prometheus after any updates, you indicate that you accept and agree to the revised terms.
2. Use of Software
Prometheus is designed to provide robust device management tools, including but not limited to remote control, automation of tasks, and bulk operations across multiple devices. Users are responsible for ensuring that their use of Prometheus complies with all applicable local, national, and international laws, including laws regarding data privacy, intellectual property, and the monitoring of devices. You may only use Prometheus for lawful purposes and in accordance with these terms.
You agree not to misuse the Software by, for example, attempting to hack or undermine the platform, engaging in activities that disrupt the service, or using Prometheus to gain unauthorized access to other systems. Misuse of the Software will result in immediate termination of your account and access to the platform, and we reserve the right to seek legal remedies if necessary.
Furthermore, you agree not to resell, sublicense, or otherwise distribute the Software to third parties without prior written consent from our company. Any such unauthorized use or distribution is strictly prohibited and may lead to legal action. We may, at our discretion, disable or terminate access to the Software if you fail to comply with these provisions.
3. Privacy and Data Collection
Your privacy is extremely important to us. In order to provide you with a seamless experience, we collect certain personal data such as your name, email address, and device information. This data is essential for the proper functioning of Prometheus and to provide customer support, track usage statistics, and improve the platform. We are committed to ensuring that your data is handled in accordance with applicable data protection laws and our Privacy Policy.
We take appropriate technical and organizational measures to secure your personal data and protect it from unauthorized access, alteration, or disclosure. However, you acknowledge that no system is completely secure, and we cannot guarantee the absolute security of your data. You are responsible for maintaining the confidentiality of your account login credentials and are liable for any activity conducted under your account.
We also collect non-personal information about your usage patterns, device identifiers, and system performance in order to monitor and improve the performance of Prometheus. By using the Software, you consent to our collection and use of this information as outlined in our Privacy Policy.
4. Limitations and Restrictions
The Free plan of Prometheus allows users to manage up to 40 devices locally and 5 devices via cloud access. In contrast, the VIP plan offers unlimited device management capabilities. Additionally, certain advanced features, such as API access and bulk data operations, may only be available to VIP users. Users of the Free plan must adhere to these limitations and may not attempt to circumvent them through unauthorized methods, including but not limited to the use of multiple accounts or illegal software modifications.
Any misuse of the limitations imposed on your plan will result in immediate suspension or termination of your account, and we reserve the right to pursue legal action for any damages incurred. You must not attempt to exceed the device limits or share your account details with third parties to extend the functionality of the Free plan.
5. Support and Updates
We provide comprehensive support to all users of Prometheus. Free plan users receive support via group Telegram channels and email, where we address common issues and provide guidance. VIP users, on the other hand, have access to dedicated private Telegram support, ensuring faster response times and personalized assistance. Our goal is to ensure that all users have access to the help they need, but we prioritize VIP users for certain support requests due to the enhanced service they have opted for.
Prometheus is continually evolving, and we are committed to providing regular updates that enhance its functionality, improve security, and fix bugs. By using the Software, you agree to accept and install these updates as they become available. Failure to install updates in a timely manner may result in reduced functionality or security vulnerabilities, for which we are not responsible.
6. Intellectual Property Rights
All content, trademarks, software, and other intellectual property associated with Prometheus remain the sole property of our company and are protected by applicable intellectual property laws. By using Prometheus, you are granted a limited, non-exclusive, and non-transferable license to use the Software for its intended purpose. You agree not to copy, reproduce, distribute, or create derivative works from any part of Prometheus without prior written consent.
Unauthorized use of our intellectual property is strictly prohibited and may result in legal action. You may not remove or alter any copyright, trademark, or other proprietary notices contained in or displayed by the Software. Any feedback, comments, or suggestions you provide to us regarding the Software become our property, and we may use them without restriction.
7. Limitation of Liability
While we strive to ensure that Prometheus operates smoothly and efficiently, you agree that your use of the Software is at your own risk. We provide Prometheus on an "as is" and "as available" basis, and we disclaim all warranties, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
In no event will we be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of profits, business interruption, or loss of data, arising out of or related to your use or inability to use the Software. Our total liability to you for any claim arising out of or related to these terms will not exceed the amount you paid for the Software in the previous 12 months or $100 if no such payments have been made.
8. Termination of Service
We reserve the right to terminate or suspend your access to Prometheus at any time, with or without cause or notice, if we believe that you have violated these terms or engaged in behavior that harms the integrity of the Software. In the event of termination, your license to use the Software will be immediately revoked, and you must cease all use of Prometheus. We may also delete your account and any associated data, without liability to you.
If you wish to terminate your account, you may do so by discontinuing your use of Prometheus and notifying us of your decision. Upon termination, all provisions of these terms that by their nature should survive termination will remain in effect, including provisions regarding intellectual property, limitation of liability, and governing law.
9. Governing Law
These terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located within California to resolve any legal matter arising from these terms. We may still apply for injunctive remedies (or an equivalent type of urgent legal relief) in any jurisdiction.
